Weekly Update


The proceedings in the Supreme Court have gripped the nation and highlighted two fundamentally different visions of how our constitution should operate. The lawyers for Miller and Cherry (and the interveners) have all made the case that the exercise of the prerogative power to prorogue should be subject to legally enforceable limits, including constitutional principles. The Government's lawyers, by contrast, have argued that the power is not subject to any relevant legal standards and therefore is not justiciable. The Supreme Court's judgment is expected early next week. Whatever decision is made, the Justices' analysis will have long term implications for the UK constitution.
