The Rule of Law in Times of Health Crises

The Bingham Centre for the Rule of Law, in partnership with the Global Health Academy of the University of Edinburgh and the Advocates for International Development's ROLE UK Programme, has developed a seminal paper on The Rule of Law in Times of Health Crises.

The authors, Dr Julinda Beqiraj , Dr Jean-Pierre Gauci  and Nyasha Weinberg  at the Bingham Centre and the British Institute of International and Comparative Law (BIICL) and Dr Luciana Brondi  of the Global Health Academy, examine the relationship between rule of law and health crises, focusing in particular on the present COVID-19 crisis. In order to limit the spread of COVID-19, preserve health systems and save human lives, governments around the world have taken measures that limit the exercise of individual freedoms and question the principle of the rule of law. The paper draws lessons about how the rule of law and its core elements have the potential to contribute to the empowerment of societies to respond to crisis situations. Identifying shared principles, this publication scrutinises domestic and international structures that determine the ability of rule of law to prevail during public emergencies, as it offers clear recommendations to how programmes aiming to strengthen the rule of law in official development assistance-eligible countries, and legal sector actors can meaningfully contribute to this response.
